§ 37-0905. Chemicals of concern and high-priority chemicals.\n  1. Chemicals of concern.\n  (a) Within two years of the effective date of this title, the\ndepartment, in consultation with the department of health, shall\npromulgate a list of chemicals of concern. A chemical may be listed as a\nchemical of concern if it has been identified by a government entity\nand/or identified on the basis of credible scientific evidence as being:\n  (i) a carcinogen, reproductive or developmental toxicant,\nneurotoxicant, asthmagen, or endocrine disruptor;\n  (ii) persistent, bioaccumulative and toxic; or\n  (iii) very persistent and very bioaccumulative.\n  (b) The department shall review lists codified or promulgated in other\nstates as chemicals of concern to determine if such chemicals meet the\ncriteria of paragraph (a) of this subdivision.
