§ 36-0105. Local responsibility.\n 1. Every local government with land use jurisdiction over any area of\nspecial flood hazard that was, prior to the effective date of this\narticle, a participant in the national flood insurance program shall\ncontinue to maintain such participation in the national flood insurance\nprogram.\n 2. Every local government with land use jurisdiction over any area of\nspecial flood hazard that was not, prior to the effective date of this\narticle, directly participating in the national flood insurance program\nbut was relying on state administration of the minimum land use\nregulations necessary to meet the requirements of the national flood\ninsurance program, must apply for and complete all requirements for\nparticipation in the national flood insurance program.\n 3. Any local government that, after the effective date of this\narticle, is notified by the federal emergency management agency of the\nexistence of an area of special flood hazard within the bounds of such\nlocal government shall promptly, within the time frames required by the\nnational flood insurance program, apply for and complete all\nrequirements for participation in the national flood insurance program.\n 4. Any local government that, prior to the effective date of this\narticle, was notified by the federal emergency management agency of the\nexistence within its bounds of an area of special flood hazard and that\nhas not qualified as of the effective date of this article for\nparticipation in the national flood insurance program shall, within the\ntime frames required by the national flood insurance program, apply for\nand complete all requirements for participation in the national flood\ninsurance program.\n
