§ 27-1915. Use of waste tire management and recycling fee funds.\n Waste tire management and recycling fees shall be deposited in the\nwaste management and cleanup fund established in section ninety-two-bb\nof the state finance law, and shall be made available for the following\npurposes:\n 1. costs of the department for the following:\n (a) first-year costs:\n (i) enumeration and assessment of noncompliant waste tire stockpiles;\nand\n (ii) aerial reconnaissance to locate, survey and characterize sites\nenvironmentally, for remote sensing, special analysis and scanning;\n (b) abatement of noncompliant waste tire stockpiles;\n (c) administration and enforcement of the requirements of this\narticle, exclusive of titles thirteen and fourteen; and\n (d) conducting an updated market analysis of outlets for waste tire\nutilization including recycling and energy recovery opportunities, which\nshall not include the incineration of waste tires.\n 2. costs of the department of economic development for the following:\n (a) conducting an updated market analysis of outlets for waste tire\nutilization including recycling and energy recovery opportunities;\n (b) establishment of a program to provide funds to businesses to\ndevelop technology that leads to increased markets for waste tires;\n (c) funding of demonstration projects, including, but not limited to,\nreuse in agricultural settings; and\n (d) administration of requirements of this section.\n 3. costs of the department of transportation for the following:\n (a) funding of demonstration and other projects for road base, paving\nand other civil engineering uses; and\n (b) administration of requirements of this section.\n 4. costs of the New York state thruway authority for the following:\n (a) funding of demonstration and other projects for road base, paving\nand other civil engineering uses; and\n (b) administration of requirements of this section.\n 5. costs of the New York state energy research and development\nauthority for the following:\n (a) funding research projects which will enhance sustainable waste\ntire recycling activities; and\n (b) administration of requirements of this section.\n 6. costs of the department of health for the following:\n (a) recommendations to protect public health;\n (b) administration of requirements of this section; and\n (c) prevention or control of on-site populations of vectors, as\ndefined in subdivision ten of section 27-2301 of this article, using\ntechniques appropriate for protection of human health and the\nenvironment to prevent the site from being a vector breeding area.\n Any funds not used for a given year shall be returned to the fund and\nbe added to the total funds available for disbursement in the succeeding\nyear.\n
