§ 27-0401. Secondary materials.\n 1. As used in this article, "secondary materials" shall mean material\nrecovered from or otherwise destined for the waste stream, including but\nnot limited to, post-consumer material, industrial scrap material and\noverstock or obsolete inventories from distributors, wholesalers and\nother companies as defined in rules and regulations promulgated by the\ncommissioner of economic development in consultation with the\ncommissioner but such term does not include those materials and\nby-products generated from, and commonly reused within, an original\nmanufacturing process.\n 2. For the purposes of this article, the department shall assist the\ndepartment of economic development in conducting secondary materials\nmarket development programs pursuant to article six of the economic\ndevelopment law, as added by chapter six hundred fifteen of the laws of\nnineteen hundred eighty-seven, and other state agencies and authorities\nconducting waste reduction and recycling programs.\n 3. The department shall assist in providing consumer education on the\neconomic and environmental benefits of solid waste management practices\nand the concomitant needs for waste reduction and for consumers to\nactively seek consumer products which contain secondary materials or\nwhich are easily recycled or reused.\n
