§ 11-108. Penalties. 1. Any person having been served with an order to\nremedy a violation of the code pursuant to the provisions of any local\nlaw or ordinance, or the procedures adopted pursuant to section three\nhundred eighty-one of the executive law, who shall fail to comply with\nsuch order within thirty days after such service or within the time\nfixed by such order for compliance, whichever is greater, and any owner,\nbuilder, architect, engineer, contractor or subcontractor taking part or\nassisting in the construction or use of any building who shall knowingly\nviolate any applicable provisions of the code or any lawful order of the\ngovernmental entity responsible for the administration and enforcement\nthereof shall be punishable by a fine of not more than one thousand\ndollars or by imprisonment of not more than thirty days in jail, or\nboth.\n 2. Except as provided otherwise by law, any such violation shall not\nbe a crime and the penalty or punishment imposed therefor shall not be\ndeemed for any purpose a penal or criminal penalty or punishment, and\nshall not impose any disability upon or affect or impair the credibility\nas a witness, or otherwise, of any person convicted thereof.\n
