Penalties for failure to comply

§ 1129. Penalties for failure to comply. 1. Willful failure of an\nemployee to prepare and submit a written report of an allegation of\nchild abuse as required by this article shall be a class A misdemeanor.\n  2. (a) Willful failure of a school administrator or superintendent to\nsubmit a written report of child abuse to an appropriate law enforcement\nauthority, as required by this article, shall be a class A misdemeanor.\n  (b) Notwithstanding paragraph (a) of this subdivision, any failure to\nsubmit a written report of child abuse to an appropriate law enforcement\nauthority as required by this article, shall be punishable by a civil\npenalty not to exceed five thousand dollars upon an administrative\ndetermination by the commissioner.\n
