* § 100. Laws repealed. Of the laws enumerated in the schedule hereto\nannexed, that portion specified in the last column is hereby repealed.\n  * NB Effective until June 26, 2026\n  * § 100. Definitions. For purposes of this article:\n  1. The term "face covering" means any item that is used to conceal,\ndisguise, or obscure the facial identity, including any opaque mask,\ngarment, helmet, headgear, balaclava, ski mask, neck gaiter, or tactical\nmask. The term "face covering" shall not include:\n  (a) a transparent face shield;\n  (b) a medical grade surgical mask or N95 respirator worn to prevent\nthe transmission of diseases or illnesses;\n  (c) a mask or apparatus worn to protect against imminent exposure to\nany toxins, gas, smoke, or other hazardous or harmful environmental\ncondition;\n  (d) a mask, helmet, self-contained breathing apparatus, or other\ndevice necessary when worn to perform duties related to a water rescue\noperation;\n  (e) a motorcycle helmet when worn by an individual using a motorcycle\nor other vehicle that requires a helmet for safe operations;\n  (f) necessary protective eyewear;\n  (g) ballistic gear worn for the purposes of physical safety;\n  (h) camouflage gear worn for the purposes of blending in to a physical\nenvironment;\n  (i) a mask or disguise worn for the purposes of active undercover\noperations;\n  (j) a garment worn for religious purposes;\n  (k) sunglasses;\n  (l) facial hair; or\n  (m) any other item worn to follow applicable laws on occupational\nhealth and safety, reasonable workplace accommodations, or to protect\nthe skin from frostbite during conditions that the law enforcement\nofficer reasonably thinks could cause frostbite.\n  2. The term "law enforcement officer" means:\n  (a) any police officer, as defined in section 1.20 of the criminal\nprocedure law;\n  (b) any peace officer, as defined in section 2.10 of the criminal\nprocedure law; or\n  (c) any federal law enforcement officer, as defined in section 2.15 of\nthe criminal procedure law.\n  * NB Effective June 26, 2026\n
