Disposition of Earnings

§ 154. Disposition of Earnings. The earnings of a prisoner\nparticipating in a work release program, less any payroll deductions\nrequired or authorized by law, shall be deposited with the department in\na trust fund account. Such earnings shall not be subject to attachment\nor garnishment in the hands of the department. The commissioner is\nauthorized to provide for disbursements from the trust fund account for\nany or all of the following purposes:\n  1. Such costs incident to the prisoner's confinement as the\ncommissioner deems appropriate and reasonable.\n  2. Such costs related to the prisoner's work release program as the\ncommissioner deems appropriate and reasonable.\n  3. Support of the prisoner's dependents.\n  4. Payment of court fines, mandatory surcharge, sex offender\nregistration fee, DNA databank fee, restitution or reparation, or\nforfeitures.\n  The balance of such earnings, if any, after disbursements for any of\nthe foregoing purposes shall be paid to the prisoner upon termination of\nhis imprisonment.\n
