§ 102. Atomic energy council. 1. There shall be within the department,\nthe atomic energy council (hereinafter sometimes referred to as the\n"council"), which shall consist of the commissioner and such other\nrepresentatives of state departments, agencies and instrumentalities\nimportantly concerned with atomic energy and such other persons as the\ngovernor may from time to time designate who shall serve at the pleasure\nof the governor.\n 2. Each member of the council may, by official order filed with the\ncouncil, designate a deputy, who, in the case of a member who is an\nofficial of the state, any instrumentality, agency or subdivision\nthereof, shall be an officer of his department, commission or public\nbenefit corporation, to perform his duties under this article. The\ndesignation of such deputy shall be deemed temporary only and shall not\naffect the civil service or retirement rights of any person so\ndesignated.\n 3. The members of the council and their respective deputies, if any,\nshall serve without compensation, but each of them shall be entitled to\nreimbursement for his actual and necessary expenses incurred in the\nperformance of his official duties.\n 4. The commissioner shall serve as chairman of the council and may\nappoint such subordinates and employees as may be necessary to carry out\nthe duties imposed upon the council by law. At any meeting or proceeding\nnot attended by the chairman, the council shall elect an acting\nchairman. Legal, technical, scientific, engineering and other services\nfor the council, other than those performed by employees of the council,\nshall be performed by personnel of the department, the state departments\nof health and labor, or other departments or agencies of the state.\n
