§ 61. License application. 1. Any person may apply to the board for a\nlicense to cultivate, process, distribute, deliver or dispense cannabis\nwithin this state for sale. Such application shall be in writing and\nverified and shall contain such information as the board shall require.\nSuch application shall be accompanied by a check or draft for the amount\nrequired by this article for such license. If the board shall approve\nthe application, it shall issue a license in such form as shall be\ndetermined by its rules. Such license shall contain a description of the\nlicensed premises and in form and in substance shall be a license to the\nperson therein specifically designated to cultivate, process,\ndistribute, deliver or dispense cannabis in the premises therein\nspecifically licensed.\n  2. Except as otherwise provided in this article, a separate license\nshall be required for each facility at which cultivation, processing,\ndistribution or retail dispensing is conducted.\n  3. An applicant shall not be denied a license under this article based\nsolely on a conviction for a violation of article two hundred twenty or\nsection 240.36 of the penal law, prior to the date article two hundred\ntwenty-one of the penal law took effect, a conviction for a violation of\narticle two hundred twenty-one of the penal law, or a conviction for a\nviolation of article two hundred twenty-two of the penal law after the\neffective date of this chapter.\n
