§ 101. Manufacturers and wholesalers not to be interested in retail\nplaces. 1. It shall be unlawful for a manufacturer or wholesaler\nlicensed under this chapter to\n (a) Be interested directly or indirectly in any premises where any\nalcoholic beverage is sold at retail; or in any business devoted wholly\nor partially to the sale of any alcoholic beverage at retail by stock\nownership, interlocking directors, mortgage or lien or any personal or\nreal property, or by any other means. The provisions of this paragraph\nshall not apply to (i) any such premises or business constituting the\novernight lodging and resort facility located wholly within the\nboundaries of the town of North Elba, county of Essex, township eleven,\nRichard's survey, great lot numbers two hundred seventy-eight, two\nhundred seventy-nine, two hundred eighty, two hundred ninety-eight, two\nhundred ninety-nine, three hundred, three hundred eighteen, three\nhundred nineteen, three hundred twenty, three hundred thirty-five and\nthree hundred thirty-six, and township twelve, Thorn's survey, great lot\nnumbers one hundred six and one hundred thirteen, as shown on the\nAdirondack map, compiled by the conservation department of the state of\nNew York - nineteen hundred sixty-four edition, in the Essex county\natlas at page twenty-seven in the Essex county clerk's office,\nElizabethtown, New York, provided that such facility maintains not less\nthan two hundred fifty rooms and suites for overnight lodging, (ii) (A)\nall that tract or parcel of land situate in the City of Canandaigua,\nCounty of Ontario, State of New York, all as shown on a map entitled\n"Meridian Automotive Systems Subdivision Plan", prepared by Costich\nEngineering, P.C., having drawn number 3203-01, last dated 8/4/2003, and\nis to be filed in the Ontario County Clerk's Office and being more\nparticularly bounded and described as follows:\nBeginning at a point on the east right-of-way line of North Bloomfield\nRoad said point also being the northwest corner of lands now or formerly\nowned by Donald and Jean Baier having T.A. # 070.19-01-06; thence\n 1. N60Á57;16"W, along said east right-of -way of North Bloomfield Road\na distance of 1,266.75 feet to a point; thence\n 2.
