Unless required by federal law, the state or an agency or instrumentality of the state shall not: A. seek payment from an account or its proceeds for benefits provided to the beneficiary of the account pursuant to 26 U.S.C. Section 529A; or B. undertake estate recovery from an account pursuant to 26 U.S.C. Section 529A. History: Laws 2016, ch. 40, § 6; repealed and reenacted by Laws 2024, ch. 17, § 2. Repeals and reenactments. — Laws 2024, ch. 17, § 2 repealed former 6-8A-6 NMSA 1978 and enacted a new section, effective July 1, 2024. Applicability. — Laws 2016, ch. 40, § 10 provided that the provisions of Laws 2016, ch. 40 apply to taxable years beginning on or after January 1, 2016.
