It is unlawful for any mortgage loan company in connection with the origination, brokering, negotiating or making of any mortgage loan, directly or indirectly, to: A. employ any device, scheme or artifice to defraud; or B. engage in any act, practice or course of business that operates or would operate as a fraud or deceit upon any person. History: Laws 1983, ch. 86, § 21; 2009, ch. 122, § 43. The 2009 amendment, effective July 31, 2009, in the first sentence, after "mortgage", added "loan"; after "company", deleted "or loan broker" and after "brokering", added "negotiating". Severability. — Laws 2009, ch. 122, § 60 provided that if any part or application of this act is held invalid, the remainder or its application to other situations or persons shall not be affected.
