Developmental disabilities council; additional duties

The developmental disabilities council shall cooperate with the health care authority to:
A. provide data to support an amendment to the developmental disabilities medicaid waiver program to increase the number of eligible persons served;
B. develop a contingency plan to describe the role and control the growth of intermediate care facilities for persons with developmental or intellectual disabilities; and
C. develop flexibility in the system of prioritization for admission to allow persons to move within the service system to an appropriate level of service, including movement of residents of intermediate care facilities for persons with developmental or intellectual disabilities to the developmental disabilities medicaid waiver program.

The 2024 amendment, effective July 1, 2024, replaced the department of health and the human services department with the health care authority as the agency with whom the developmental disabilities council shall cooperate to fulfill its duties with regard to supporting programs for persons with developmental or intellectual disabilities; and after "shall cooperate with the" deleted "department of health and the human services department" and added "health care authority".
The 2023 amendment, effective June 16, 2023, updated terms relating to developmental and intellectual disabilities; in Subsections B and C, deleted "mentally retarded" and added "individuals with developmental or intellectual disabilities".
