At the time of filing a declaration of candidacy for the office of representative, a candidate shall reside in the district for which the candidate files. Thereafter, if a representative permanently removes the representative's residence from or maintains no residence in the district from which the representative was elected, the representative shall be deemed to have resigned, and a successor shall be selected as provided in Section 4 [2-7F-4 NMSA 1978] of the 2021 House Redistricting Act.

Effective dates. — Laws 2021 (2nd S.S.), ch. 6 contained no effective date provision, but, pursuant to N.M. Const., art. IV, § 23, was effective March 17, 2022, 90 days after adjournment of the legislature.
