As used in the State Carbon Dioxide Act [19-10A-1 to 19-10A-7 NMSA 1978]: A. "gas or carbon dioxide" means carbon dioxide whether in a gaseous or liquid form; B. "producer" means a person producing crude oil in New Mexico who: (1) is a participant in a carbon dioxide project for enhanced recovery of crude oil and related hydrocarbons from a reservoir in New Mexico; and (2) does not own or control a source of carbon dioxide which is sufficient to supply the carbon dioxide for the enhanced recovery project; C. "refiner" means a person who owns a petroleum refinery located in New Mexico; and D. "state carbon dioxide" means carbon dioxide which the commissioner of public lands may take in kind as royalty under a lease issued by the state or carbon dioxide which the commissioner of public lands has the right to purchase under leases issued pursuant to Sections 19-10-3 and 19-10-4 NMSA 1978.
