Provisions Applicable to All Persons Under This Chapter

I. No person making a retail installment contract, shall advertise, print, display, publish, distribute, or broadcast or cause or permit to be advertised, printed, displayed, published, distributed, or broadcast, in any manner whatsoever, any statement or representation with regard to the rates, terms, or conditions which is false, misleading, or deceptive. II. Persons subject to this chapter shall be responsible for the supervision of their employees, agents, and branch offices. Licensees shall establish and maintain a system to supervise the activities of their employees, agents, and branch offices that is reasonably designed to achieve compliance with this chapter and any rules adopted thereunder. III. Each licensee shall maintain a positive net worth of at least $25,000 at all times. IV. Examination expenses, fines, penalties, and other moneys owed to the department shall be paid within 14 days of receipt of notice by the licensee or other person or at such later time as determined by the commissioner.
