I. Any natural person who violates RSA 167:17-b shall, unless otherwise specified, be guilty of: (a) A class A felony if the value of the monetary award or goods or services in question exceeds $1,500; (b) A class B felony if the value of the monetary award or goods or services in question exceeds $1,000 but does not exceed $1,500; or (c) A misdemeanor if the value of the monetary award or goods or services in question is $1,000 or less. II. Any other person who violates RSA 167:17-b shall, unless otherwise specified, be guilty of: (a) A felony if the value of the monetary award or goods or services in question exceeds $1,000; or (b) A misdemeanor if the value of the monetary award or goods or services in question is $1,000 or less. III. In the case of any natural person convicted of fraudulently using, presenting, transferring, acquiring, receiving, possessing or altering food stamps, the court may permit such person to perform work approved by the court for the purpose of providing restitution for losses incurred by the United States and the department of health and human services as a result of the offense for which such person was convicted. If the court permits such person to perform such work and such person agrees thereto, the court shall withhold the imposition of the sentence on the condition that such person perform the assigned work. Upon the successful completion of the assigned work the court may suspend such sentence.
