Nevada Code § 711.040

Community antenna television system defined

1. Community antenna television system
means any facility, or any component thereof, which is:
(a) Located within this State;
(b) Constructed in whole or in part in, on, under
or over any public right-of-way or highway; and
(c) Operated to perform for hire the service of:
(1) Receiving and amplifying the signals
broadcast by one or more television stations or provided for public,
educational or governmental purposes and redistributing those signals by wire,
cable or other means of closed transmission; or
(2) Providing two-way interactive services
by wire, cable or other means of closed transmission, including, without
limitation, Internet services, intranet services and electronic mail,
to members
of the public who subscribe to the service.
2. The term does not include any system
which serves:
(a) Fewer than 50 subscribers; or
(b) Only the residents of one or more apartment
dwellings under common ownership, control or management, and commercial
establishments located on the premises of those dwellings, if the buildings are
separated by not more than one public right-of-way or highway.
3. As used in this section, apartment
dwelling does not include a hotel, motel, condominium, town house or other
similar dwelling.
