1. Any agent or person in charge of the books, accounts, records, minutes or papers of any private, common or contract motor carrier or broker of any of these services who refuses or fails for a period of 30 days to furnish the Authority or Department with any report required by either or who fails or refuses to permit any person authorized by the Authority or Department to inspect such books, accounts, records, minutes or papers on behalf of the Authority or Department is liable to a penalty in a sum of not less than $300 nor more than $500. The penalty may be recovered in a civil action upon the complaint of the Authority or Department in any court of competent jurisdiction. 2. Each days refusal or failure is a separate offense, and is subject to the penalty prescribed in this section.
