Intoxication and other violations of duties; penalties

1. Any person employed upon any railway as
engineer, motorman, gripman, conductor, switch tender, fireman, bridge tender,
flagger or signaler, or having charge of stations, starting, regulating or
running trains upon a railway, who shall be intoxicated while engaged in the
discharge of any such duties, shall be guilty of a gross misdemeanor.
2. Every engineer, motorman, gripman,
conductor, brakeman, switch tender, train dispatcher or other officer, agent or
servant of any railway company, who shall be guilty of any willful violation or
omission of his or her duty as such officer, agent or servant, by which human
life or safety shall be endangered, for which no punishment is specially
prescribed, shall be guilty of a misdemeanor.
