Portfolio energy system or efficiency measure defined

Portfolio energy system or efficiency
measure means:
1. Any renewable energy system:
(a) Placed into operation before July 1, 1997, if
a provider of electric service used electricity generated or acquired from the
renewable energy system to satisfy its portfolio standard before July 1, 2009;
(b) Placed into operation before July 1, 1997,
that uses waterpower from a plant, facility, equipment or system to generate
electricity, if the waterpower is acquired by the provider of electric service
from another party pursuant to a contract for a term of not less than 10 years
and the provider of electric service began acquiring the waterpower from the
plant, facility, equipment or system before April 22, 2019; or
(c) Placed into operation on or after July 1,
1997.
2. Any energy efficiency measure installed
on or before December 31, 2019.
