Investigation of verified complaint; verified answer; action by Commissioner after informal hearing

1. Upon the filing with the Commissioner
of a verified complaint against any collection agency or compliance manager,
the Commissioner shall investigate the alleged violation of the provisions of
this chapter.
2. If the Commissioner determines that the
complaint warrants further action, the Commissioner shall send a copy of the
complaint and notice of the date set for an informal hearing to the accused and
the Attorney General.
3. The Commissioner may require the
accused collection agency or compliance manager to file a verified answer to
the complaint within 10 days after service unless, for good cause shown, the
Commissioner extends the time for a period not to exceed 60 days.
4. If at the hearing the complaint is not
explained to the satisfaction of the Commissioner, the Commissioner may take
such action against the accused as may be authorized by the provisions of this
chapter.
