Limitations on issuance of licenses

1. The Board shall not issue a license to
conduct a pharmacy:
(a) To any practitioner; or
(b) To any partnership, corporation or
association in which a practitioner has a controlling interest or owns more than
10 percent of the available stock.
2. This section does not:
(a) Apply to a hospital pharmacy or a health
maintenance organization which holds a certificate of authority under chapter 695C of NRS.
(b) Prohibit ownership by a practitioner of a
building in which a pharmacy is located, if space for the pharmacy is rented at
the prevailing rate.
