Requirements for program of postgraduate education or training to be deemed progressive; exceptions

1. For the purposes of this chapter:
(a) Except as otherwise provided in this section,
a program of postgraduate education or training is progressive if each year of
the program progresses in a continuous manner and the person who completes the
program does so in sequence without any breaks of 12 weeks or longer.
(b) The Board shall deem a program of
postgraduate education or training approved by the Accreditation Council for
Graduate Medical Education, including, without limitation, such a program that
includes 1 year or more of scientific or clinical research, to be progressive
if the person who completes the program does so in the format that was approved
by the Accreditation Council for Graduate Medical Education.
2. Notwithstanding the provisions of
subsection 1, the Executive Director of the Board or a designee thereof may, in
his or her discretion upon review of the program, determine that a person has
completed a progressive program of postgraduate education or training if the
person:
(a) Completed 1 or more years in a program that
meets the requirements of subsection 1; and
(b) Enrolled in a program that is closely related
to the program described in paragraph (a) and completed that program without
any breaks of 12 weeks or longer.
