Restrictions on acceptance by solar installation company of payment for installation of distributed generation system

1. Except as otherwise provided in
subsection 2, a solar installation company shall not accept any payment for the
installation of a distributed generation system from a purchaser, lessee, host
customer, distributed generation system financier or any other person before
the date on which:
(a) If the distributed generation system will be
connected to the power grid, the distributed generation system receives
permission from the appropriate public utility to connect to the power grid.
(b) If the distributed generation system will not
be connected to the power grid, the distributed generation system passes a
final inspection and becomes operational.
2. A solar installation company may,
before the date specified in subsection 1, accept as an initial down payment or
deposit to be paid for the installation of the distributed generation system a
payment in an amount that does not exceed $1,000 or 10 percent of the aggregate
contract price, whichever is less.
