The examination of pesticides or devices must be made under the direction of the Director to determine whether they comply with the requirements of this chapter. If it appears from the examination that a pesticide or device fails to comply with the provisions of this chapter, the Director shall cause appropriate notice to be given to the person. Any person so notified must be given an opportunity to present the persons views, orally or in writing, and if thereafter in the opinion of the Director it appears that the provisions of this chapter have been violated by the person, the Director may impose a civil penalty pursuant to NRS 586.965 . The provisions of this chapter do not require the Director to commence formal proceedings for any act or failure to act if the Director believes that the public interest will be best served by a suitable notice of warning in writing.
