1. A consignor creditor claiming to be injured by the fraud of a licensee may bring an action upon the bond against the principal and the surety in any court of competent jurisdiction to recover the damages caused by the fraud. 2. The Director or any consignor creditor may also bring an action upon the bond against the principal and the surety in any court of competent jurisdiction to recover the damages caused by any failure to comply with the provisions of this chapter and the rules and regulations adopted by the Department.
