1. In addition to any criminal penalty imposed pursuant to this chapter, any person violating any provision of this chapter or any regulation adopted pursuant thereto is subject to a civil penalty not to exceed: (a) For the first violation, $1,500; (b) For a second violation, $3,000; and (c) For each subsequent violation, $5,000. 2. If a defendant is convicted of violating any provision of this chapter or any regulation adopted pursuant thereto, the court shall order the defendant to pay a civil penalty pursuant to subsection 1. The court shall fix the manner and time of payment. 3. Any money collected from the imposition of a civil penalty pursuant to this section must be accounted for separately and: (a) Fifty percent of the money must be used to fund a program selected by the Director of the State Department of Agriculture that provides loans to persons who are engaged in agriculture and who are 21 years of age or younger; and (b) The remaining 50 percent of the money must be deposited in the Account for the Control of Weeds established by NRS 555.035 .
