Nevada Code § 554.235

Civil penalty

1. In addition to any criminal penalty
imposed pursuant to this chapter, any person violating any provision of this
chapter or any regulation adopted pursuant thereto is subject to a civil
penalty not to exceed:
(a) For the first violation, $1,500;
(b) For a second violation, $3,000; and
(c) For each subsequent violation, $5,000.
2. If a defendant is convicted of
violating any provision of this chapter or any regulation adopted pursuant
thereto, the court shall order the defendant to pay a civil penalty pursuant to
subsection 1. The court shall fix the manner and time of payment.
3. Any money collected from the imposition
of a civil penalty pursuant to this section must be accounted for separately
and:
(a) Fifty percent of the money must be used to
fund a program selected by the Director of the State Department of Agriculture
that provides loans to persons who are engaged in agriculture and who are 21
years of age or younger; and
(b) The remaining 50 percent of the money must be
deposited in the Account for the Control of Weeds established by NRS 555.035 .
