Fishways and fish ladders: Construction and maintenance; penalty

1. Every person who has erected, or who
may hereafter erect, any dams, water weirs or other obstructions to the free
passage of fish in the rivers, streams, lakes or other waters of the State of
Nevada shall construct and keep in repair, to the satisfaction of the
Department, fishways or fish ladders at all such dams, water weirs or other
obstructions so that at all seasons of the year fish may ascend above such
dams, water weirs or other obstructions to deposit their spawn.
2. Every person so placing, controlling or
owning any such obstruction who fails to comply with the provisions of this
section after having been notified in writing so to do by the Department, and
every person who at any time willfully or knowingly destroys, injures or
obstructs any fishway or fish ladder which is required by law is guilty of a
misdemeanor.
