A license must not be issued to conduct pari-mutuel wagering at a track which is less than 100 miles from another track at which pari-mutuel betting is already licensed to be conducted during the race meet of the track first licensed unless: 1. A different type of race is conducted at the second track; 2. The second track is a county fair race meeting authorized by the Commission which does not exceed 10 days in duration during that calendar year; or 3. The other track or tracks are located in a county whose population is 700,000 or more and on the premises of a resort hotel.
