Regulations of Commission regarding corrective action, evidence of financial responsibility; determination of whether corrective action is required

1. The Commission shall by regulation
establish requirements for:
(a) Corrective action to be taken in response to
a release from a storage tank;
(b) Ensuring that the corrective action is
cost-effective; and
(c) Maintaining evidence of the financial
responsibility of owners and operators of storage tanks.
2. In determining whether corrective
action is required by the presence of excessive petroleum in the soil, the
Division shall consider, unless waived by the Administrator of the Division:
(a) Factors peculiar to the site and to the
contaminant; and
(b) The use of methods developed by the American
Society for Testing and Materials to assess health and environmental risks, or
equivalent procedures, to establish the need for corrective action and the
required level of corrective action.
