Creation; appointment of members; appointment of chair and co-chair; resources

1. When there is an accident or motor
vehicle crash which poses a significant danger to public health and safety, or
a near accident or motor vehicle crash of this nature, in a facility or a group
of facilities, or when the Governor declares that a committee to oversee the
management of risks in a facility, or group of facilities, would be in the best
interests of the public health and safety, the Governor shall create such a
committee for the facility or group of facilities which may represent a
catastrophic threat to public health and safety.
2. To the extent practicable, the Governor
shall appoint the members of the committee from the membership of the State
Emergency Response Commission.
3. The Governor shall appoint to the
committee at least three persons who represent the facility or group of
facilities which may represent a catastrophic threat to public health and
safety.
4. The Governor shall appoint the chair
and may appoint a co-chair of the committee from among the members.
5. The Division shall provide to the
committee necessary resources such as clerical assistance and funding
sufficient for the committee to perform its duties.
