Controlled substance analog: Treatment as substance in schedule I; notice of prosecution; determination by Board

A
controlled substance analog, to the extent intended for human consumption, must
be treated, for the purposes of NRS 453.011 to 453.552 , inclusive, as a substance
included in schedule I. Within 30 days after the initiation of prosecution with
respect to a controlled substance analog by indictment or information, the
district attorney shall notify the Board of information relevant to scheduling
by extraordinary regulation as provided for in NRS 453.2184 . If the Board finally
determines that the controlled substance analog should not be scheduled, no
prosecution relating to that substance as a controlled substance analog may be
commenced or continued.
