Municipal solid waste landfills: Program to monitor compliance with permits, laws and regulations; allowance of intervention

1. A solid waste management authority
shall establish a program to monitor the compliance of a municipal solid waste
landfill with the terms and conditions of the permit issued for that municipal
solid waste landfill, the regulations of the State Environmental Commission,
the applicable laws of this state and the provisions of the Resource
Conservation and Recovery Act. The program must include procedures to:
(a) Verify the accuracy of any information
submitted by the owner or operator of the municipal solid waste landfill to the
authority;
(b) Verify the adequacy of sampling procedures
and analytical methods used by the owner or operator of the municipal solid
waste landfill; and
(c) Require the owner or operator to produce all
evidence which would be admissible in a proceeding to enforce compliance.
2. The solid waste management authority
shall receive and give appropriate consideration to any information submitted
by members of the public regarding the continuing compliance of an owner or
operator with the permit issued by the solid waste management authority.
3. In the administration of any permit
issued by a solid waste management authority, the authority shall establish
procedures that permit intervention pursuant to Rule 24 of the Nevada Rules of
Civil Procedure. The authority shall not oppose intervention on the ground that
the applicants interest is adequately represented by the solid waste
management authority.
