Powers of Division to apply for and accept gifts, grants and bequests; disposition of money; administration of account

1. The Division may apply for and accept
gifts, grants and bequests to carry out the provisions of this section and NRS 439.495 .
2. Any money that is accepted by the
Division pursuant to subsection 1 and any legislative appropriations made to
carry out the Chronic Obstructive Pulmonary Disease Program established
pursuant to NRS 439.495 must be
deposited in the State Treasury and accounted for separately in the State
General Fund.
3. Except as otherwise provided by the
terms of a gift, grant or bequest, expenditures from the account must be made
only for carrying out the provisions of this section and NRS 439.495 .
4. The Administrator shall administer the
account.
5. Money in the account does not revert to
the State General Fund at the end of a fiscal year. The interest and income
earned on the money in the account, after deducting any applicable charges,
must be credited to the account. Any claims against the account must be paid as
other claims against the State are paid.
