1. If a living community approves a request to install and use an electronic communication device in the bedroom of a resident pursuant to NRS 435.785 , the resident or the representative of the resident is solely responsible for: (a) Choosing the electronic communication device, subject to the limitations prescribed by subsection 3; (b) The cost of the electronic communication device; (c) The cost of installing, maintaining and removing the electronic communication device, if applicable, other than the cost of electricity used to power the electronic communication device if the resident does not pay for electricity for his or her bedroom; and (d) The cost of any repairs required due to the installation or removal of the device. 2. A resident who ceases to reside in a living community or the representative of such a resident remains solely responsible for the costs described in subsection 1, including, without limitation, such costs that are incurred after the person leaves the living community. 3. An electronic communication device chosen by a resident or the representative of a resident pursuant to subsection 1 must: (a) Be capable of being temporarily disabled or turned on and off; and (b) If the device communicates using video or other visual transmission, to the greatest extent practicable, be installed: (1) With a fixed viewpoint; or (2) In a manner that avoids capturing images of activities such as bathing, dressing and toileting.
