Program to provide medical assistance to certain persons who are employed and have disabilities

1. Upon approval of the Interim Finance
Committee, the Director, through the Division, shall establish a program for
the provision of medical assistance to certain persons who are employed and
have disabilities. The Director shall establish the program by:
(a) Amending the State Plan for Medicaid in the
manner set forth in 42 U.S.C. 1396a(a)(10)(A)(ii)(XIII);
(b) Amending the State Plan for Medicaid in the
manner set forth in 42 U.S.C. 1396a(a)(10)(A)(ii)(XV); or
(c) Obtaining a Medicaid waiver from the Federal
Government to carry out the program.
2. The Director may require a person
participating in a program established pursuant to subsection 1 to pay a
premium or other cost-sharing charges in a manner that is consistent with
federal law.
