Notice of violation by chair of county commissioners; repair by county if violator fails or refuses to repair

1. The chair of the board of county
commissioners shall notify at once the person or persons violating the
provisions of NRS 405.120 to 405.160 , inclusive, to make such
construction or repair as may be necessary.
2. If such person or persons, firm,
association or corporation shall refuse or neglect to make the same for a
period of 5 days after receiving such notice, then the chair of the board of
county commissioners shall:
(a) Immediately cause the necessary construction
or repairing to be made according to the standard plan and specifications.
(b) Submit in duplicate to the board of county
commissioners and the district attorney itemized bills for the expense so
incurred.
3. The bills shall be allowed and paid as
other bills against the road fund of the district in which the construction or
repairing is made. If there is no money in the road fund, then the bills shall
be allowed and paid out of any moneys in the county general fund not otherwise
appropriated.
