Nevada Code § 392.140

Conditions under which pupil declared habitual truant; exemption due to inability to attend school for physical or mental reasons; applicability

1. Any child who has been declared a
truant three or more times within one school year must be declared a habitual
truant.
2. Any child who has once been declared a
habitual truant and who in an immediately succeeding year is absent from school
without the written approval of the childs teacher or the principal of the
school pursuant to subsection 1 or 2 of NRS
392.130 may again be declared a habitual truant, unless the child is
physically or mentally unable to attend school as provided in NRS 392.130 .
3. The provisions of this section apply to
all pupils who are required to enroll in and attend school pursuant to NRS 392.040 .
