1. If a pupil is enrolled in a charter
school, the pupil may enroll full-time in a program of distance education only
if the charter school in which the pupil is enrolled provides the program of
distance education.
2. A pupil who is enrolled in a charter
school may enroll part-time in a program of distance education that is provided
by a school district or another charter school and is not required to obtain
the approval of the governing body of the charter school in which the pupil is
enrolled.
3. If a pupil who is enrolled in a charter
school enrolls in a part-time program of distance education that is provided by
a school district or another charter school, the governing body of the charter
school in which the pupil is enrolled shall enter into a written agreement with
the board of trustees of the school district or governing body of the charter
school, as applicable, that provides the program of distance education. The
agreement must include, without limitation, the amount of the apportionment
provided to the charter school in which the pupil is enrolled that will be
allocated pursuant to paragraph (b) of subsection 2 of NRS 387.124 to the school district or
charter school, as applicable, that provides the program of distance education.
4. A separate agreement must be prepared
for each year that a pupil enrolls in a program of distance education.
5. If the charter school in which the
pupil is enrolled and the board of trustees of the school district or governing
body of the charter school, as applicable, that provides the program of
distance education are unable to reach an agreement as required pursuant to
subsection 3, the Superintendent of Public Instruction will determine the
amount of the apportionment which the charter school in which the pupil is
enrolled is required to allocate pursuant to paragraph (b) of subsection 2 of NRS 387.124 to the school district or
charter school, as applicable, that provides the program of distance education.
