Publication of list of approved distance education courses

1. The Department shall prepare and
publish a list of courses of distance education that satisfy the requirements
of NRS 388.820 to 388.874 , inclusive, and all other
applicable statutes and regulations. If an application to provide a program of
distance education is approved pursuant to NRS
388.838 , the Department shall automatically include on the list each course
of study included within that program if the course of study had not been
approved pursuant to this section before submission of the application to
provide the program.
2. A person or entity that has developed a
course of distance education, including, without limitation, a vendor of a
course of distance education, the Nevada System of Higher Education or other
postsecondary educational institution, a board of trustees of a school district
or a governing body of a charter school, may submit an application for
inclusion of the course on the list prepared by the Department. The Department
shall approve an application if the application satisfies the requirements of NRS 388.820 to 388.874 , inclusive, and all other
applicable statutes and regulations. The Department shall provide written
notice to the applicant of its approval or denial of the application.
3. If the Department denies an
application, the Department shall include in the written notice the reasons for
the denial and the deficiencies of the application. The applicant must be
granted 30 days after receipt of the written notice to correct any deficiencies
identified in the written notice and resubmit the application. The Department
shall approve an application that has been resubmitted pursuant to this
subsection if the application satisfies the requirements of NRS 388.820 to 388.874 , inclusive, and all other
applicable statutes and regulations.
