Nevada Code § 34.005

Prosecuting agency defined

As
used in this chapter, prosecuting agency means:
1. The district attorney of the county in
which the judgment of conviction or sentence being challenged in a petition for
a writ of habeas corpus was obtained, if the district attorney or a deputy
district attorney prosecuted the petitioner in the original proceeding which
led to the judgment of conviction or sentence; or
2. The Attorney General, if the Attorney
General or a deputy attorney general prosecuted the petitioner in the original
proceeding which led to the judgment of conviction or sentence being challenged
in a petition for a writ of habeas corpus.
