Statement of appointing authority upon refusal to evaluate or certify; appeal to Commission

1. When an appointing authority refuses to
evaluate an applicant or, after an evaluation, refuses to certify a person, the
applicant or person may request the appointing authority to furnish to the
applicant or eligible person a statement of the reasons for the refusal to
evaluate or the refusal to certify, as the case may be. The appointing
authority shall furnish the statement upon request.
2. If an appointing authority refuses to
evaluate an applicant or, after an evaluation, refuses to certify a person, the
applicant or person may take an appeal to the Commission in accordance with
regulations adopted by the Commission. If the Commission finds that the
appointing authority is in error in refusing to evaluate an applicant or in
refusing to certify a person, the Commission shall order the appointing
authority to evaluate or certify, and the appointing authority shall comply.
