Review and approval of public works. [Effective upon the proclamation by the Governor of this State of the withdrawal by the State of California from the Tahoe Regional Planning Compact or of a finding by the Governor of this State that the Tahoe Regional Planning Agency has become unable to perform its duties or exercise its powers.]

1. Every public works project proposed to
be constructed within the region must be submitted to the Agency for its review
and recommendation as to conformity with the regional plan.
2. Except as provided in subsection 3, a
public works project must not be constructed unless it has been approved by the
Agency.
3. If the public works project is proposed
and is to be constructed by a department of this State, the Agency shall submit
its recommendations to the executive head of the department and to the
Governor, but the project may be constructed as approved by the executive head
of the department.
