Exceptions to exemptions from regulations or ordinances

1. The provisions of NRS 274.110 , 274.120 and subsection 1 of NRS 274.130 do not apply to regulations
adopted pursuant to any statute whose purpose is the protection of the
environment, the preservation of historic places and landmarks, or the
protection of persons against discrimination on the basis of race, color, religion,
sex, sexual orientation, gender identity or expression, marital status,
national origin or handicap.
2. No exemption, modification or
alternative to any regulation adopted under NRS
274.110 , 274.120 or 274.130 is effective which:
(a) Presents a significant risk to the health or
safety of persons resident in or employed within a specially benefited zone;
(b) Conflicts with federal law or regulations
such that the State, or any local government or any area of the State other
than specially benefited zones, or any business located outside of a specially benefited
zone would be disqualified from a federal program or from federal tax benefits
or other benefits;
(c) Suspends or modifies a regulation
specifically required by law; or
(d) Eliminates or reduces benefits to persons who
are residents of or employed within a zone.
