Powers and duties of town board or board of county commissioners

1. The town board or board of county
commissioners shall institute and maintain any suit in any court necessary in
their judgment to enforce any right of any unincorporated town.
2. All such suits must be prosecuted in
the name of the town board or board of county commissioners for the use and
benefit of the inhabitants of the town, and must be entitled accordingly in all
pleadings and proceedings.
