Temporary appointments

1. When, at any time, there shall be in
the county offices, except the office of district judge, no officer duly
authorized to execute the duties thereof, some suitable person may be
temporarily appointed by the board of county commissioners to perform the
duties of such offices, until they are filled by election or appointment, as
provided by law. In case there is no board of county commissioners in such
county, the Governor may, on notice of such vacancy, create or fill such board.
2. Any person so appointed, in pursuance
of subsection 1, shall, before proceeding to execute the duties assigned the
person, qualify in the same manner as required by law of the officer in whose
place he or she shall be appointed; and he or she shall continue to exercise
and perform the duties of the office to which he or she shall be so appointed
until the election of his or her successor at the next ensuing biennial
election, and the qualification of such successor thereafter.
