Conveying false information relating to assisted reproduction; penalty; notice of conviction to professional licensing board

1. A person shall not knowingly convey to
a patient false information or information the person reasonably should have
known was false relating to assisted reproduction, including, without
limitation, false information or information the person reasonably should have
known was false concerning:
(a) The identity, date of birth or address of the
donor at the time of donation;
(b) The human reproductive material used or
provided to the patient for assisted reproduction;
(c) The medical history of the donor or family of
the donor, including, without limitation:
(1) Past and current illnesses of the
donor; and
(2) Genetic information of the donor; and
(d) The social history of the donor.
2. A person who violates this section is
guilty of a category C felony and shall be punished as provided in NRS 193.130 .
3. Upon conviction of a person for a
violation of the provisions of this section, the Attorney General shall give
notice of the conviction to each professional licensing board that has issued a
license, certificate or registration to the person.
4. As used in this section:
(a) Genetic information means any information
that is obtained from a genetic test.
(b) Genetic test means a test, including a
laboratory test that uses deoxyribonucleic acid extracted from the cells of a
person or a diagnostic test, to determine the presence of abnormalities or
deficiencies, including carrier status, that:
(1) Are linked to physical or mental
disorders or impairments; or
(2) Indicate a susceptibility to illness,
disease, impairment or any other disorder, whether physical or mental.
