Nevada Code § 163.5551

Circumstances in which trust advisers are considered fiduciaries

If one or more trust
advisers are given authority, by the terms of an instrument, to direct, consent
to or disapprove a fiduciarys investment decisions, the investment trust
advisers shall be considered fiduciaries when exercising that authority unless
the instrument provides otherwise.
